FNG defending turf in contract

As it seeks approval for a proposed liquefied natural gas supply agreement, Fairbanks Natural Gas LLC wants regulators to differentiate between in-house counsel and outside counsel when it comes to who can see confidential materials pertaining to the case.

The request would prevent the Fairbanks North Star Borough legal department from accessing confidential portions of the case. The borough would still have access to the confidential materials through outside counsel hired to manage its appearance in the case.

Because the Fairbanks North Star Borough is one of the three municipal entities behind the Interior Gas Utility, which is authorized to provide service through much of the region, Fairbanks Natural Gas believes it would be “inappropriate” for in-house counsel to have access to information about Fairbanks Natural Gas’ suppliers and affiliates.

Fairbanks Natural Gas made a similar request in its related rate case.
